The are being skeptical of scientific findings and thinking of reasons they might be wrong. Probably a good idea. The only problem is they won't be critical about one particular conclusion they had before they ever saw a fossil or a nested hierarchy of ERV insertions; namely that the Bible might be wrong. So when presented with enough evidence that any reasonable person would conclude supports the scientific explanation, they can never accept that it is true. Besides which, even if there were a Supreme Court case of some kind, we have seen that the DI's stance changed from "Intelligent Design" to "Strengths and Weaknesses."
